Introduction

Welcome to AccessibilityWay! These Terms of Service (“Terms”) form a legally binding agreement between you, the user, and AccessibilityWay (“Company,” “we,” “our,” or “us”). By accessing or using our automated web accessibility solution (“AccessibilityWay”), our website at www.accessibilityway.com (the “Website”), or any other software, features, products, content, services, third-party software, services, tools, solutions, or providers we implement through the Services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms.

Consent to Privacy Policy

By entering into these Terms and accessing or using the Services, you also consent to our access, collection, use, and disclosure of your personal information as described in our Privacy Policy, which is incorporated into these Terms by reference.

User Eligibility and Account Types

The Services are intended for use by properly represented entities or individuals of legal age to form binding contracts under applicable law, but in no event are they intended for users under the age of 18. By using the Services, you represent and warrant that you meet these eligibility requirements. The Services are not available to any person or entity who has had their User Account temporarily or permanently deactivated or anyone seeking to use the Services in violation of these Terms or the law.

These Terms apply to all users of the Services, which include:

  • “Customer”: any individual or entity that uses or purchases a license to use AccessibilityWay or accesses or uses any of the Services.
  • “End User”: any individual that accesses and uses the Website or uses one of the products offered on a Customer Website.

If you are entering into these Terms on behalf of a legal entity, you represent that you have the authority to bind such an entity to these Terms, in which case “you” will refer to that entity. If you do not have such authority or do not agree with these Terms, you must not accept these Terms or use the Services.

Services Overview

The purpose of the Services is to assist you in making your websites accessible in accordance with the Web Content Accessibility Guidelines Version 2.1 (WCAG) at the AA level success criteria and the Americans with Disabilities Act (ADA). AccessibilityWay is provided on a Software as a Service (SaaS) basis, requiring you to purchase a license for use. It consists of two components:

  1. A user interface that addresses UI and design-related adjustments
  2. An AI-powered background process that addresses more complex accessibility requirements, including optimization for screen readers and keyboard navigation, for the website for which the Customer purchases a license to use AccessibilityWay (the “Customer Website”)

Please note that AccessibilityWay does not support the following items:
URL parameters, which are not treated as pages, files, and/or images; if you have URLs that can only be accessed using

  • URL parameters, AccessibilityWay will not process them
  • Documents, PPT, EXCEL, WORD, PDF, audio, video, SVG, Parallax animations, embedded content
  • Canvas, Flash

If you use AccessibilityWay and wish to receive general information and guidance about what you can do to defend against a third-party claim relating to the levels of accessibility of your Customer Website, you need to contact us, and we will provide you with such general information, which is not to be construed as legal services. If you choose to request such general information, a dedicated support email thread will be used to handle your request, communicate with you, and provide you with the information. You acknowledge and agree that if you send us any emails outside the dedicated support email thread, these emails may be overlooked and/or not addressed. It is your responsibility to ensure that any communication with us regarding general information requests and third-party claims is made only via the dedicated support email thread. You agree that if you choose to request information, it will be deemed part of the Services and be subject to all terms and conditions of these Terms.

Note that AccessibilityWay does not provide legal advice or services. The information and services provided are intended to assist with website accessibility but should not be relied upon as a substitute for professional legal counsel. Customers should consult with their own legal counsel regarding ADA compliance and any related matters.
